Interim Government: Not Bound by the Rome Statute, ICC Membership Lacks Legitimacy

The Interim Government of Afghanistan has declared that it is not bound to the International Criminal Court (ICC) or the Rome Statute, and that the previous fallen republic’s accession to the statute holds no legal validity.

In a statement, the Interim Government criticized the ICC for operating based on political biases rather than adhering to the principles of justice and fairness. It pointed out the court’s silence regarding major crimes, particularly those committed in Afghanistan.

The statement also highlighted the ICC’s failure to take action against the war crimes committed by occupying forces and their allies in Afghanistan. It condemned the court’s indifference to the widespread atrocities that resulted in the deaths of thousands of civilians, including women, children, and the elderly.

The Interim Government concluded by noting that many major countries are not members of the ICC. For countries like Afghanistan, which has long suffered under foreign occupation and colonialism, membership in such an institution is seen as unnecessary.
